{"id":4745,"date":"2026-01-29T11:51:04","date_gmt":"2026-01-29T11:51:04","guid":{"rendered":"https:\/\/bihavadis.com\/?p=4745"},"modified":"2026-01-29T11:51:04","modified_gmt":"2026-01-29T11:51:04","slug":"araci-kurumlardan-spk-cezasina-itiraz","status":"publish","type":"post","link":"https:\/\/bihavadis.com\/index.php\/2026\/01\/29\/araci-kurumlardan-spk-cezasina-itiraz\/","title":{"rendered":"Arac\u0131 kurumlardan SPK cezas\u0131na itiraz"},"content":{"rendered":"<div>\n<p>Arac\u0131 kurumlardan Sermeya Piyasas\u0131 Kurulu&#8217;nun (SPK) 53 arac\u0131 kuruma kesilen idari para cezalar\u0131na itiraz geldi.<\/p>\n<p>Borsa Arac\u0131 Kurumlar\u0131 Y\u00f6neticileri Derne\u011fi taraf\u0131ndan yap\u0131lan a\u00e7\u0131klamada, Ekim 2024 tarih ve 2024\/50 say\u0131l\u0131 SPK b\u00fclteninde ilan edilen ve 6 \u015eubat 2023 Pazartesi Kahramanmara\u015f merkezli deprem felaketinin oldu\u011fu g\u00fcn saat 09.52&#8217;de, arac\u0131 kurumlara tebli\u011f edilen SPK&#8217;n\u0131n depo \u015fart\u0131 ve a\u00e7\u0131\u011fa sat\u0131\u015f yasa\u011f\u0131 karar\u0131n\u0131n uygulanmamas\u0131n\u0131n gerek\u00e7e g\u00f6sterilerek 53 arac\u0131 kuruma idari para cezas\u0131 kesilmesinin a\u00e7\u0131klamay\u0131 zorunlu k\u0131ld\u0131\u011f\u0131 belirtildi.<\/p>\n<\/div>\n<div>\n<p>A\u00e7\u0131klamada, y\u00fczbinlerce insan\u0131n enkaz <b>alt\u0131nda<\/b> kald\u0131\u011f\u0131, b\u00fcy\u00fck felaket g\u00fcn\u00fcnde herkesin 17 A\u011fustos 1999 depremi sonras\u0131nda oldu\u011fu gibi borsada i\u015flemlerin ge\u00e7ici olarak durdurulmas\u0131 beklenirken sabah a\u00e7\u0131l\u0131\u015f seans\u0131n\u0131n 09.40&#8217;da ba\u015flat\u0131\u011f\u0131na dikkat \u00e7ekildi.<\/p>\n<p>Depo \u015fart\u0131 kural\u0131n\u0131n SPK taraf\u0131ndan 6 \u015eubat 2023 Pazartesi ak\u015fam kald\u0131r\u0131ld\u0131\u011f\u0131 ifade edilen a\u00e7\u0131klamada, borsada i\u015flemlerinde 8 \u015eubat 2023 \u00c7arsamba g\u00fcn\u00fc gecikmeli de olsa durduruldu\u011fu aktar\u0131ld\u0131.<\/p>\n<p>Bir g\u00fcnl\u00fck depo \u015fart\u0131 kurulan\u0131 uyulmamas\u0131 nedeniyle 1,5 y\u0131l sonra 53 arac\u0131 kuruma ceza kesilmesinin isabetli olmad\u0131\u011f\u0131 dile getirilen a\u00e7\u0131klamada, &#8220;Ba\u015fta ileti\u015fimsizlik, adapte olabilmek i\u00e7in \u00e7ok k\u0131sa zaman olmas\u0131 ve otomasyon sistemlerindeki teknik problemlerin b\u00fcy\u00fck etkisine ra\u011fmen bir g\u00fcnl\u00fck s\u00fcrede depo \u015fart\u0131 kural\u0131na uygun olmayan son derece c\u00fcz&#8217;i miktarda i\u015flem ger\u00e7ekle\u015fmi\u015f olmas\u0131 dikkate al\u0131nmayarak, sanki depo \u015fart kural arac\u0131 kurumlarca ihlal edilmi\u015f gibi, ayr\u0131ca birtak\u0131m i\u015flemlerin a\u00e7\u0131\u011fa sat\u0131\u015f olarak de\u011ferlendirilerek olaydan 1,5 sene sonra 53 arac\u0131 kuruma konuya ili\u015fkin idari para cezas\u0131 verilmesinin isabetli bir de\u011ferlendirme olmad\u0131\u011f\u0131n\u0131 sayg\u0131yla kamuoyonun bilgisine arz ederiz&#8221;
